The software, APIs, mapping integrations, mobile applications, and web tools provided by OLOL Tracker Solutions (owned by Manoj Kumar, Sole Proprietor, 63 VPO- Badgaon, Saharanpur U.P. - 247452, India (IN); Phone: +91 7302 7302 03, Email: care@ololtracker.com) are provided strictly on an "as-is" and "as-available" basis without express or implied warranties.
1. GPS Telemetry Precision & Map Drift Disclaimer
As is standard for location-based software, OLOL Tracker relies on the Global Positioning System (GPS) chip inside the user's mobile device, mapping APIs, and cellular tower triangulations. Environmental factors—including dense urban high-rise buildings, underground parking, heavy cloud cover, atmospheric signal reflection, and physical GPS hardware degradation—can cause minor geographic variances or temporary signal drift. OLOL Tracker makes no absolute warranty that recorded coordinates or route snapping will achieve 100% mathematical zero-error accuracy at every single second.
2. Smartphone OEM Battery Optimization Interruption
Certain smartphone operating systems (such as Xiaomi MIUI/POCO, Oppo ColorOS, Vivo FuntouchOS, Realme UI, Huawei) implement aggressive background process killers. If an employee/member revokes background permissions, turns off device GPS, or fails to grant "Unrestricted Battery" and "Autostart" permissions as guided in our Setup Guide, location streaming may pause until the user re-opens the app. OLOL Tracker shall not be held liable for unrecorded location points caused by user-side permission revocation or device OS kills.
3. Employer Regulatory & Labor Law Compliance
The Organization Administrator assumes sole legal responsibility for ensuring that their deployment of OLOL Tracker complies with local labor laws, employment contracts, and statutory privacy requirements regarding workforce monitoring. Manoj Kumar / OLOL Tracker is a software technology provider and assumes no liability for disputes between employers and field members regarding shift timings, attendance records, or location data.
4. No Emergency Dispatch Guarantee
OLOL Tracker is an operational field management and group coordination software. It is NOT a certified emergency response or municipal dispatch system (such as Police 100/112, Ambulance 108, or Fire Emergency services). In critical life-threatening situations, users must contact official emergency municipal services directly.
5. Commercial Payment & Gateway Disclaimer
All subscription transactions conducted on www.ololtracker.com are encrypted via PCI-DSS certified payment aggregators (Razorpay, Paytm, UPI, Net Banking). OLOL Tracker does NOT store full credit/debit card numbers or CVVs on its servers. B2B commercial terms and pro-rata refunds are strictly governed by our Terms & Conditions and Privacy Policy.
6. Limitation of Liability
To the maximum extent permitted by applicable Indian law, in no event shall Manoj Kumar, OLOL Tracker Solutions, or its developers be held liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from the use of, or inability to use, the software—including but not limited to loss of business profits, delivery delays, data loss, or device battery consumption.
7. Intellectual Property, UI/UX Design & Brand Asset Disclaimer
All website designs, mobile app user interfaces, button elements, graphics, icons, logos, brand elements, source code, and conceptual workflows ("function of thought") are the sole proprietary creations of Manoj Kumar. Unauthorized reproduction, copying, cloning, reverse engineering, scraping, or creation of derivative look-alike applications is strictly illegal under the Indian Copyright Act 1957, Trade Marks Act 1999, and Information Technology Act 2000. Violators will face immediate civil injunctions, statutory damage claims, and criminal prosecution.
8. Ironclad Owner Indemnification, Hold Harmless & Absolute Legal Insulation
To ensure complete transparency and absolute legal insulation for the software owner (Manoj Kumar, Proprietor of OLOL Tracker Solutions), all users, Organization Admins, and subscribers expressly agree to the following ironclad indemnity terms:
- Absolute Hold Harmless & Indemnification: Subscribers and users agree to defend, indemnify, and hold harmless Manoj Kumar and OLOL Tracker Solutions from and against any and all claims, lawsuits, administrative penalties, labor disputes, employee grievances, police inquiries, or legal expenses arising out of or related to their use of the platform.
- Neutral Technology Provider Status: The Software Owner acts purely as an independent B2B technology vendor providing location software tools. The Owner has no control over, and assumes zero responsibility for, how Organization Admins manage their field staff, record shifts, or enforce internal company policies.
- Zero Liability for User Misuse: In the event of any unauthorized tracking, misuse, or violation of privacy by individual users or rogue administrators, the sole legal and criminal liability rests entirely with the violating user/admin. The Software Owner maintains zero liability and cooperates fully with law enforcement.
